How To Check Public Arrest Records for Free in El Paso County Texas

The most effective and common way to search jail records is to look up the county jail. County jails are where individuals go when they are arrested by the county sheriff’s office or any of the local police departments. Generally, jails maintain an online directory where members of the public can find out if someone has been arrested and the reason for the arrest.

However, if you are looking for El Paso County bookings, it should be noted that there is no online arrest search. The El Paso County Sheriff’s Office Detention Bureau operates the county jail and downtown El Paso detention center.1 If someone has been arrested they will be booked in one of these jails.

Learn how to find recent El Paso County arrest information and how to find out if someone is in jail below.

Search the El Paso County Jail for Recent Arrests

As mentioned above, the El Paso County Sheriff’s Office maintains two jails – the county jail, and the downtown jail. The El Paso County Jail Annex is the county jail. It is the larger of the two and more restrictive of detainee and inmate movement.

The Downtown Detention Center is the smaller jail that also houses the Magistrate Court, Border Patrol, and other agencies.2

Unfortunately, neither the county jail nor the downtown jail hosts an online database. However, the Sheriff’s Office provides phone numbers to call to find someone’s mugshot.

Interested parties should begin their search by calling the numbers above and inquiring about detainees and inmates. In the event this method does not produce the information you need, contact the police department you believe initiated the arrest. Additionally, you can visit the jails in person by going to the addresses below:

The EPCSO does not offer a public records request form, however, the county of El Paso provides instructions for how to make requests from its departments.3

Essentially, you must make a written request that clearly identifies what type of records you are requesting and direct the request to the EPCSO. You should also call before to find out if there will be an associated fee. In response, the EPCSO must promptly produce the information unless it has reason to withhold it. They must get a decision from the Attorney General within 10 days in order to do so.

How To Execute an El Paso County Arrest Warrant Search

Persons interested in obtaining warrant information in El Paso should first check with the Sheriff’s Office.11 Law enforcement agencies in El Paso County provide fugitive records to the Sheriff’s Office to compile into a weekly wanted fugitives list.

Additionally, the sheriff’s office endorses the non-profit community police organization Crime Stoppers of El Paso. This organization compiles a more in-depth wanted suspects list that includes a suspect’s:

  • Mugshot
  • Name
  • Physical characteristics
  • Age
  • Warrant/Charge
  • Bond

If none of the lists above contain the person of interest you are looking for, you will not be able to ascertain more insight from the EPCSO Warrants Office. They explicitly state that no warrant information will be given to members of the general public.

Interested persons must instead find these El Paso public records by going to the nearest sheriff’s substation or Warrant’s Office inside the El Paso County Detention Facility. The facility is located at:

El Paso County Jail
601 East Overland
El Paso, Texas 79901

How To Get a Background Check Done in El Paso County Texas

Getting a background check can inform interested parties about another person’s past criminal history. Background checks can be performed for both personal and professional purposes.

Personal background checks can be performed by anyone and for any reason by searching government agency public records or by using third-party providers. Generally, personal background checks are name-based, meaning you only need to know an individual’s name to get one done.

Because the records are public, consent is not necessarily required by the subject of the background check. Further, a reason does not need to be stated. However, you cannot conduct a background check on another person for illegal or unlawful purposes, like stalking, harassing, intimidating, or stealing their identity.

The El Paso County Clerk provides name-based background check services. Interested persons can submit a background check form via email to [email protected] or via mail/in-person to the Clerk’s Office at:

El Paso County Clerk
500 East San Antonio, Ste 105
El Paso, TX 79901

The El Paso County Sheriff’s Office offers the public personal background check services.13 This service checks arrest records generated by the Sheriff’s Office. Although the records are public, the EPCSO requires notarized authorization if the request is for someone other than the person making the request.

To make a request, interested parties must complete a background check form. This form can be submitted in three ways:

EPCSO Records Section
3850 Justice Dr.
El Paso, TX 79938

  • Hand deliver to the Sheriff’s Office Headquarters listed above between the hours of 8:00 am – 4:00 pm Monday – Friday

The fee is $6 and must be paid before the background check is processed.

On the state level, the Texas Department of Public Safety offers a name-based criminal history conviction search. The database includes all conviction and deferred adjudication information reported to the DPS for cases classified as class B misdemeanors or greater. To use the database, users must create an account and pay a search fee.

For more information, contact the Texas Department of Public Safety at 855.481.7070.

Professional background checks are typically done for employment, licensing, firearms, housing, insurance, elder and child care positions, volunteer positions, and more. These types of background checks are fingerprint-based and do require the subject’s consent.

The EPCSO also provides fingerprint-based background check services. Fingerprinting is done at the Sheriff’s Office Headquarters at:

El Paso County Sheriff’s Office
3850 Justice Dr.
El Paso, TX

Fingerprint services are available between the hours of 8:00 a.m. – 11:30 a.m. and 1:00 p.m. – 4:00 p.m. on Tuesdays and Thursdays. The first fingerprint card has a $10 fee, additional fingerprint cards are $5.

The Texas DPS has implemented the Fingerprint Applicant Services of Texas (FAST) to manage professional background check requests and fulfillment. This is done through the IndentGo platform.

An employer, agency, or other eligible organization must provide an individual with a service code. From there, the individual must schedule a fingerprint session at one of the local IndentGo locations. The locations in El Paso County are:

IdentoGO
7400 Viscount Boulevard
Suite 218
El Paso, TX 79925

IdentoGO
7250 North Mesa Street
Suite C
El Paso, TX 79912

A professional background check should not cost any money for the employee or candidate. The agency or organization requiring the professional background check should take care of any associated fees.

There are several legal constraints that agencies, employers, and organizations must abide by concerning background checks. For example, the Fair Credit Reporting Act requires an applicant’s written consent before requesting a background check.

Additionally, under Texas Law, employment positions that pay $75000 or less cannot include criminal arrests and convictions on the consumer report if they are more than seven years old.

More on protections and consumer laws in the final section.

Understanding Your Rights & Using El Paso Public Records Responsibly

Regardless of whether a background check is personal or professional, it is always important to maintain respect for that person’s information. It should never be used in unlawful ways, and those who obtain these records should understand the federal laws governing these searches.

Local, state, and federal laws are in place to protect individuals and ensure ethical use of personal details. Agencies also ensure people’s rights are observed. The following are important to be aware of and abide by when using someone’s criminal record or background information:

  • Fair Credit Reporting Act (FCRA): Federal law that outlines the use and distribution of consumer information.21 This includes your credit report and other identifying financial records. Protections include the right to request a copy of your file, the right to dispute false reporting, the limitation of reporting outdated details, and the required consent of the party being reported on.
  • Equal Employment Opportunity Commission (EEOC): This governing body prevents employers from discriminating against potential employees based on their credit, criminal record, or membership in a protected class.22 It also allows you to dispute or file a claim against anyone you feel has discriminated against you. More information is available at the link.
  • Federal Trade Commission (FTC): Among other things, this commission’s job is to look into and protect against background check fraud, checks without consent, and rejection without proper notice.23
  • Texas Workforce Commission: This is the body that governs proper business practices in Texas. They can help with resources for those in need. They have an entire page dedicated to laws and practices that any Texas business owner needs to know regarding background checks and so much more.
  • United States Department of Labor: This body governs most of the laws put into practice by each state concerning labor. The topic page will provide a brief overview of the things they are in charge of and help abide by the laws.
